Subject: Recent Verdict in Shelby County, Texas — December 13, 2010

Scott McLemore of McLemore, Reddell, Ardoin & Story, PLLC are pleased to announce that they, along with the other members of the trial team, were successful in the representation of clients in a theft of trade secrets, breach of fiduciary duty and fraud case filed in Shelby County, Texas against Southwestern Energy. After two weeks of trial and two days of deliberations in a hotly contested case, the jury returned a finding that the Plaintiff and Intervenors’ trade secrets were stolen, misappropriated, that Southwestern Energy had committed fraud in obtaining the valuable trade secrets, violated its fiduciary duty and breached its confidentiality agreement.

The jury awarded $11,450,000 for the theft of trade secrets and fraud and determined that Southwestern had profited $381,500,000 as a result of the fraud and theft of trade secrets, under a disgorgement of profits claim. We are humbled and thankful for the jury’s sacrifice and service in hearing the evidence and making a decision which honors the hard work of the oil and gas scientists who were victims of corporate greed and had their ingenuity, hard work and labor stolen by a large corporation that was bent on profits over doing what was right.

I am also personally thankful to those members of the trial team who worked to provide a favorable outcome throughout the duration of the long, four-year battle. It was an honor to work with them. The jury served Justice and we are thankful for their sacrifice and courage, as well as our system of justice.
